Antidiscrimination clause required in state contracts as of Jan. 1, 2024

SB 5186 Implementation – Antidiscrimination clause required in state contracts as of Jan. 1, 2024 – In 2023, the Legislature passed Senate Bill 5186 that requires an antidiscrimination clause in public contracts starting Jan. 1, 2024.
DES developed an antidiscrimination clause that agencies can insert into public works and goods and services contracts, as required by the bill. DES collaborated with the OMWBE, Office of Equity, and the Human Rights Commission to draft the language.
The antidiscrimination clause must be included in every contract for public works and goods and services beginning Jan. 1, 2024, and does not apply to contracts signed before Jan. 1, 2024.
DES will be implementing the clause in all of its new public works contracts, and the contracts it manages for client agencies, by Jan. 1, 2024.
All tiers of contractors are also required to include the clause in all contracts, including subcontracts, by Jan. 1, 2024.
